»Probably because trademark stuff.«
I'm not a legal expert, but the trademark explanation always sounded like bunk to me.

The 1932 novelization is public domain and is explicitly called "King Kong." As far as I know, that means nobody can ever claim to own that phrase outright, they can only trademark its usage as it pertains to media they've created. What's more, I decided to look into a bit just now, and I could not find any record of a live trademark on "King Kong" (or even "Kong" for that matter) by any of the Kong movies' rightsholders.

Even on its face the argument doesn't make much sense. If somebody supposedly owns Kong and his name (which they don't), why would Legendary be able to negotiate using every other aspect of the character but not the prefix "King" in his name? Especially because Warner Bros. co-finances and distributes these movies, and they own the first two Kong films from 1933 through their acquisition of Turner. Even if somebody like Universal wanted to come after them, they'd have no case.
